Can I still have a motorcycle injury claim if the driver says they “didn’t see me”?
Yes. A driver saying they "didn't see you" does not automatically excuse them from responsibility. In many cases, it may actually support the argument that they failed to keep a proper lookout.
To help protect your claim:
- Seek medical care immediately, even if you think your injuries are minor.
- Take photos of the motorcycle, vehicles involved, roadway, and your injuries.
- Save your riding gear, including your helmet, jacket, gloves, and boots, as they may help demonstrate the force of the impact.
