What is the difference between Michigan no-fault benefits and a personal injury lawsuit after a crash?

Michigan's no-fault insurance system provides certain benefits regardless of who caused the accident. However, those benefits are different from a personal injury lawsuit against the at-fault driver.

No-fault benefits may help cover:

  • Medical expenses (subject to your selected coverage level)
  • Lost wages
  • Replacement services for household tasks you can't perform because of your injuries
  • Mileage to medical appointments and certain other allowable expenses

A personal injury lawsuit, on the other hand, seeks compensation from the at-fault party for losses that no-fault benefits do not fully cover, such as:

  • Pain and suffering
  • Emotional distress
  • Permanent disability or disfigurement
  • Excess medical expenses or lost income beyond available no-fault benefits
